Exports of cultural assets to other countries

As in the previous case, permits for permanent export, temporary export with option to sell, or temporary export outside of Spain are required in all cases as follows:

  • For cultural assets over 100 years old.
  • For those included in the General Inventory of Historical Heritage Personal Property.

Council Regulation EC 116/2009, del Consejo del 18 de diciembre de 2008 relativo a la exportación de Bienes Culturales, regarding cultural asset exports, is applicable to assets that are less than 100 years old:

  • An export permit is required for all assets between 50 and 100 years old whenever their value exceeds the following amounts:

Assets between 50 and 100 years old with a value below the aforementioned amounts must apply for the export permit, however they will receive a certificate from the Ministry informing the customs authorities that the work does not require an export permit.

Only temporary export permits, never permanent or temporary with option to sell permits, may be requested for:

  • Assets of cultural value or those for which a file has been opened to declare as an Asset of Cultural Value.
  • Assets that have been declared non-exportable as a precautionary measure.
  • Publicly owned assets.
  • No export permit is required (although the export applicant must submit a sworn statement or other document certifying the current situation of the works before Customs) for:
    • Assets between 50 and 100 years old with a value below the figures indicated above.
    • Assets under 50 years old, by either living or deceased authors.
